Baby abandoned in bag in Elmira released from hospital

A baby who police say was left outside in a plastic bag for 72 hours after being abandoned by its mother has been released from the hospital.

Elmira police Sgt. William Solt confirmed the 8-month-old girl recovered enough from her ordeal to be released and is now in foster care.

Neighbors discovered the girl Aug. 8 behind a house in the 600 block of Walnut Street in Elmira.

Police charged the baby's mother, 17-year-old Harriette Hoyt of Sayre, with second-degree attempted murder, a felony that carries a possible penalty of 25 years in prison if she's convicted.

Hoyt last week waived a preliminary hearing in City of Elmira Court and her case will be heard by a grand jury before being transferred to Chemung County Court.

Hoyt agreed to waive a preliminary hearing in exchange for a reduction in bail and open file discovery, which requires the District Attorney's Office to turn all evidence over to the defense.

Hoyt also waived extradition, meaning if she makes bail and leaves New York and doesn't return to show up in court, she doesn't have the right to an extradition hearing if she is arrested in any other state.

Hoyt remains in the Chemung County Jail in lieu of $125,000 cash bail or $250,000 bond.
